These terms define the rules for using the Book a Balloon platform by passengers and operators.
Platform — the bookaballoon.com website enabling users to search and book balloon flights and purchase vouchers.
Operator — an independent service provider performing balloon flights. Passenger — a person making a booking or using a voucher. Booking — an order for a specific flight date and time.
Maciej Szymczuk, sole proprietor (Book a Balloon), NIP: 9661876768, acts as an intermediary in booking services and does not itself provide balloon flight services as the carrier.
The flight service contract is concluded directly between the Passenger and the Operator. The Operator remains an independent service provider responsible for performing the flight.
Booking requires passenger data, contact details, and successful online payment. Booking confirmation is sent by email after payment is completed.
The contract is considered concluded once payment is confirmed by the payment provider and a booking code is issued.
During the booking process, passengers may optionally consent to receive SMS notifications about their booking status. Consent is voluntary and may be withdrawn at any time by contacting the platform.
Payments are processed by Stripe. Available payment methods are shown in checkout. All prices are shown in PLN as gross amounts.
The Operator is the seller of the flight service, and Book a Balloon acts as a technological and organisational intermediary in the booking and payment process.
Book a Balloon charges the Operator remuneration for intermediation. It is not added to the Passenger as a separate checkout fee.
For flight bookings on a specific date and time, the right of withdrawal does not apply under Article 38(12) of the Polish Consumer Rights Act (leisure services for a specific date).
For voucher purchases (without a specific flight date), consumers have a 14-day right of withdrawal, provided the voucher has not been used.
Cancellation rules may differ by Operator and are presented with each flight offer. The platform presents operator rules and supports communication during cancellation.
For operational purposes, time bands such as 48h/24h/day-of-flight may affect rebooking or refund conditions.
Passenger-initiated date changes (self-rebooking) are available only when the Operator has cancelled or rescheduled the original flight. In that case, the Passenger may pick another flight with the same Operator through the booking status page. Self-rebooking is permitted once per booking — any further change must be coordinated directly with the Operator.
A passenger-initiated date change is independent of price differences between flights. The platform does not charge extra for selecting a more expensive flight and does not refund the difference when selecting a cheaper flight — the amount paid for the original booking remains unchanged.
Booking transfers are only possible between flights run by the same Operator. Changing Operator is not available through self-rebooking and requires contact with customer support.
The Operator/pilot decides whether a flight must be cancelled due to weather or safety conditions.
In weather-cancellation cases, the Operator offers a new date or refund according to the applicable policy and legal requirements.
Complaints related to platform operation can be submitted to office@bookaballoon.com. A response is provided within 14 days.
Complaints concerning the flight service itself should be addressed to the Operator as the service provider, with optional mediation support from the platform.
Book a Balloon is responsible for platform operation and booking intermediation, but is not liable for performance of flight services delivered by Operators.
The Operator is responsible for safety, compliance with aviation law, and proper delivery of the flight service.
Personal data processing rules are described in the Privacy Policy available at /polityka-prywatnosci.
Passenger, voucher buyer, or voucher recipient data is shared with the relevant Operator only to the extent necessary to perform the flight, handle the voucher, and process settlements.
Acceptance of the Terms and Privacy Policy is recorded with the document version, date, IP address, and browser information. The consent log is retained for 5 years in accordance with GDPR Article 7(1).
Upon request, personal data may be exported or anonymised via the form at /dane-osobowe. Financial and tax data, including invoices, sale amounts, payments, and settlements, is retained for the legally required period and cannot be deleted during that period.
Contracts concluded through the platform are governed by Polish law. Disputes are resolved by the competent court according to applicable regulations.
